Support to drafting Negotiating Position for Chapter 3

Prior to opening negotiations on Chapter 3, Serbia needs to prepare Draft Negotiating Position, presenting the plans regarding future legislative and institutional framework aligned with the acquis in relation to services in the internal market, i.e. Chapter 3 – Right of Establishment and Freedom to Provide Services. The Ministry of Trade, Tourism and Telecommunications, Ministry of Education, Science and Technological Development and other members of the Negotiating Group for Chapter 3 (covering areas of services, mutual recognition of professional qualifications and postal services) were provided assistance in this task between November 2017 to March 2018.

Following the analysis of the existing national legislation and institutional framework in the relevant area, the PLAC II Project Expert Konstantinos Bouas prepared the first version of Draft Negotiating Position for Chapter 3 – for the part related to the freedom of establishment, the freedom to provide cross-border services and for the mutual recognition of professional qualifications.

Similarly, the PLAC II Project Expert Alessandra Fratini, having analysed national legislation and institutional framework in the area of postal services, performed gap analysis of the draft Law on Postal Services in relation to the Postal Directive and prepared the proposal for the content of the first version of Drafting Negotiating position as regards postal services.

In addition to this, she developed proposals on the main provisions of by-laws accompanying the new Law on Postal Services (namely the Regulation on conditions for the provision of the universal postal service, the Regulation on conditions for the start of performing activities of postal services and the Regulation on conditions for maintaining and improving the provision of universal postal service, in connection with individuals with disabilities).
